END USER LICENSE AGREEMENT

This EULA governs your use of the Application. Your use of our services, websites, and other features is also governed by our Terms of Service and Privacy Policy, which are incorporated by reference into this EULA. In the event of any conflict between this EULA and the Terms of Service, the Terms of Service shall control with respect to service-related matters, and this EULA shall control with respect to software licensing matters.

1. LICENSE GRANT

Subject to your compliance with the terms and conditions of this EULA, Gut Feelings grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Application on a single mobile device that you own or control, solely for your personal, non-commercial use.

This license is granted solely for the purpose of using the Application in accordance with its intended functionality and the terms set forth in this EULA and our Terms of Service.

2. RESTRICTIONS ON USE

You may NOT:

• Copy, modify, adapt, alter, translate, or create derivative works of the Application;
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Application;
• Remove, alter, or obscure any proprietary notices, labels, or marks on the Application;
• Rent, lease, lend, sell, sublicense, assign, distribute, publish, transfer, or otherwise make available the Application or any features or functionality of the Application to any third party;
• Use the Application for any commercial purpose or in any manner that violates any applicable law, regulation, or third-party right;
• Use the Application to transmit any viruses, malware, or other harmful code;
• Use the Application in any way that could damage, disable, overburden, or impair our servers or networks;
• Use any automated system, including "robots," "spiders," or "offline readers," to access the Application;
• Collect or harvest any information from the Application;
• Use the Application in any manner that violates our Terms of Service or Privacy Policy;
• Attempt to gain unauthorized access to any portion of the Application or any systems or networks connected to the Application;
• Use the Application to track, monitor, or collect information about other users without their express consent;
• Use the Application in any way that infringes upon the intellectual property rights of Gut Feelings or any third party.

Any unauthorized use of the Application will result in immediate termination of this license and may subject you to civil and criminal penalties.

3. INTELLECTUAL PROPERTY RIGHTS

The Application, including all content, features, functionality, design, text, graphics, images, logos, icons, audio clips, video clips, digital downloads, data compilations, software, and the selection and arrangement thereof, is owned by Gut Feelings, its licensors, or other providers of such material and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

This EULA does not grant you any rights to use Gut Feelings' trademarks, service marks, logos, domain names, or other brand features. All rights not expressly granted to you in this EULA are reserved by Gut Feelings and its licensors.

4. UPDATES AND MODIFICATIONS

Gut Feelings may, from time to time, provide updates, upgrades, patches, bug fixes, or other modifications to the Application (collectively, "Updates"). Updates may be automatically downloaded and installed on your device, or you may be required to manually download and install Updates. You agree to receive and install Updates as they become available.

Gut Feelings reserves the right to modify, suspend, or discontinue the Application or any part thereof at any time, with or without notice. Gut Feelings may also impose limits on certain features or restrict your access to parts or all of the Application without notice or liability.

This EULA will govern any Updates provided by Gut Feelings, unless such Updates are accompanied by a separate license, in which case the terms of that license will govern.

5. THIRD-PARTY SERVICES AND CONTENT

The Application may integrate with or provide access to third-party services, content, or applications, including but not limited to:

• Apple HealthKit - For importing health data from your iOS device
• Google Services - For authentication and other services
• Payment Processors - For processing subscription and purchase payments
• Food Databases - Including USDA FoodData Central and other nutritional databases
• Healthcare Provider Directories - For finding healthcare providers
• Analytics Services - For understanding app usage and improving services

Your use of third-party services is subject to the terms and conditions and privacy policies of those third parties. Gut Feelings is not responsible for the availability, accuracy, or content of third-party services or for any transactions you may enter into with third parties.

6. HEALTH AND MEDICAL DISCLAIMERS

IMPORTANT HEALTH WARNINGS:

• NOT FOR MEDICAL EMERGENCIES: If you think you may have a medical emergency, call your doctor or 911 immediately. Do not use the Application for emergency medical situations.
• NOT A DIAGNOSTIC TOOL: The Application is designed to help you track symptoms, food intake, and lifestyle factors. It does not diagnose medical conditions, and any patterns or correlations identified by the Application are informational only and should not be used as a basis for medical decisions.
• CONSULT YOUR HEALTHCARE PROVIDER: Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read or learned through the Application.
• EXISTING MEDICAL CONDITIONS: If you have any existing medical conditions, you must consult with your healthcare provider before using the Application. Continued use without the recommendation of a healthcare provider may result in negative health impacts. If your healthcare provider advises against using the Application, you must immediately discontinue use.
• PREGNANCY AND NURSING: If you are pregnant, nursing, or planning to become pregnant, consult your healthcare provider before using the Application.
• MEDICATION INTERACTIONS: The Application may provide information about medications and their potential gastrointestinal side effects. This information is for educational purposes only and does not replace consultation with your healthcare provider or pharmacist regarding medication interactions, side effects, or contraindications.
• DATA ACCURACY: While we strive to provide accurate information, we do not guarantee the accuracy, completeness, or timeliness of any data, including nutritional information, food database entries, symptom tracking data, or correlation analyses. Nutritional information is derived from third-party databases and may contain errors or omissions.
• NO WARRANTIES: Gut Feelings makes no representations or warranties regarding the accuracy, reliability, or usefulness of any health-related information, insights, correlations, or recommendations provided by the Application.

7. HEALTH DATA AND PRIVACY

The Application collects, stores, and processes sensitive health information, including but not limited to:

• Symptom tracking data
• Food intake and dietary information
• Mood and stress levels
• Sleep patterns
• Exercise data
• Medication information
• Health metrics from HealthKit integration

Your health data is protected in accordance with our Privacy Policy and Consumer Health Data Privacy Policy. By using the Application, you consent to the collection, use, and disclosure of your health data as described in those policies.

You are responsible for:

• Maintaining the confidentiality of your account credentials
• Ensuring that your device is secure and protected
• Not sharing your account with others
• Promptly notifying us of any unauthorized access to your account

You may export or delete your data at any time through the Application's settings or by contacting us at support@gutfeelings.app.

8. USER CONTENT AND DATA

You retain ownership of any data, information, or content you input into the Application ("User Content"). However, by using the Application, you grant Gut Feelings a worldwide, royalty-free, non-exclusive license to use, store, process, and display your User Content solely for the purpose of providing, improving, and maintaining the Application and our services.

You represent and warrant that:

• You have the right to provide User Content to Gut Feelings
• Your User Content does not violate any third-party rights
• Your User Content is accurate and truthful
• Your User Content does not contain any harmful, illegal, or offensive material

Gut Feelings reserves the right to remove or disable access to any User Content that violates this EULA or our Terms of Service.

9. DISCLAIMER OF WARRANTIES

Gut Feelings does not warrant that:

• The Application will meet your requirements or expectations
• The Application will be uninterrupted, timely, secure, or error-free
• The results obtained from using the Application will be accurate or reliable
• Any errors or defects in the Application will be corrected
• The Application is free of viruses or other harmful components

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

10. LIMITATION OF LIABILITY

11. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Gut Feelings, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of this EULA
• Your use of the Application
• Your User Content
• Your violation of any third-party rights
• Any health-related decisions or actions you take based on information from the Application

12. TERMINATION

This EULA is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any of its terms.

Gut Feelings may, in its sole discretion, terminate or suspend your access to the Application at any time, with or without cause or notice, for any reason, including if Gut Feelings believes that you have violated or acted inconsistently with this EULA or our Terms of Service.

Upon termination:

• Your right to use the Application will immediately cease
• You must delete the Application from your device
• All provisions of this EULA that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability

13. EXPORT RESTRICTIONS

You acknowledge that the Application may be subject to export restrictions. You agree to comply with all applicable international and national laws that apply to the Application, including the Export Administration Regulations, as well as end-user, end-use, and destination restrictions issued by U.S. and other governments.

14. GOVERNING LAW AND DISPUTE RESOLUTION

This EULA shall be governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to its conflict of law provisions.

Any disputes arising out of or relating to this EULA or the Application shall be resolved in accordance with the dispute resolution provisions set forth in our Terms of Service, including mandatory binding arbitration.

15. SEVERABILITY

If any provision of this EULA is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this EULA shall otherwise remain in full force and effect and enforceable.

16. ENTIRE AGREEMENT

This EULA, together with our Terms of Service and Privacy Policy, constitutes the entire agreement between you and Gut Feelings regarding the Application and supersedes all prior or contemporaneous communications, proposals, and agreements between you and Gut Feelings relating to the Application.

17. MODIFICATIONS TO THIS EULA

Gut Feelings reserves the right to modify this EULA at any time. We will notify you of any material changes by:

• Posting the updated EULA in the Application
• Providing notice through the Application
• Sending an email to the address associated with your account (if applicable)
• Updating the "Last Modified" date at the top of this EULA

Your continued use of the Application after any such modifications constitutes your acceptance of the modified EULA. If you do not agree to the modified EULA, you must stop using the Application and delete it from your device.
